Terms & Conditions – YOU MUST READ

SCOPE

Before you become a member of 360 Motor Racing Club (360MRC) and enter any event that 360MRC organise, you must read and accept all of the terms and conditions in and linked to, this agreement. We strongly recommend that, as you read this agreement, you also access and read the linked information (Regulations). By accepting this agreement, you agree that this agreement and terms and conditions of this agreement shall apply to your membership and entrance to the 360 Motor Racing Club and any related event organised by the 360 Motor Racing Club. Please now read these terms and conditions carefully before filling in the relevant entry form. You will need to confirm that you have read and accepted these terms and conditions together with the relevant regulations in order to be accepted as a member of the 360 Motor Racing Club and to compete in any event organised by the 360 Motor Racing Club. Once you have agreed to the terms and conditions and regulations and filled in the entry form you will be asked for a financial commitment, which is legally binding under UK law and subject to these terms and conditions and agreement. The 360 Motor Racing Club does not accept any responsibility or liability as to the validity or authenticity of any information submitted to The 360 Motor Racing Club via this interface. It is the responsibility of the registering party to confirm all information is correct and valid. The 360 Motor Racing Club and The 360 Motor Racing Club Limited accepts no liability for any loss or circumstantial subsequent loss to the registering party or any related or unrelated third party as a result of failure to read and understand and accept these terms and conditions or from submittance by the registering party of incorrect or false information. The Financial commitment is subject to UK law, is payable to The 360 Motor Racing Club Limited and consists of two components which are comprised as follows.

MEMBERSHIP AND MEMBERSHIP FEE

A membership subscription fee is £50 plus VAT. Membership is to the 360 Motor Racing Club and not The 360 Motor Racing Club Limited. Membership does not entitle the member to any shareholding or any share ownership or share related  interest or voting rights within The 360 Motor Racing Club Limited of any kind. Membership does not entitle the member to any voting rights within the 360 Motor Racing Club.  Membership is compulsory in order to register for and compete in any event that the 360 Motor Racing Club organises. The subscription period to membership of the 360 Motor Racing Club runs from the acceptance and payment in full of the subscription fee being received to the 31st December 2016 for a period of one year from acceptance of registration and is non negotiable, non transferable and non redeemable. Should a member of the 360 Motor Racing Club resign or withdraw from the club, or should their membership be withdrawn due to behaviour unbefitting of a member of the 360 Motor Racing Club, their subscription for the year in which they resigned or their membership was withdrawn will be forfeit. Membership of the 360 Motor Racing Club is linked to entrance to any event that the 360 Motor Racing Club may organise, and this will be subject to the supplementary regulations as published by the 360 Motor Racing Club for the event.

ENTRY FEE

To enter a motor car to the 360 Motor Racing Club Endurnace races is subject to the terms and conditions as detailed in this agreement and the regulations and supplementary relevant regulations of the 360 Motor Racing Club, the relevant entry fee shall be payable to The 360 Motor Racing Club Limited together with the Membership Subscription fee.

1. The entrance fee will be accepted in date and time order and will guarantee an acceptance of entry subject to both the acceptance of the terms and conditions together with full compliance to those terms and conditions and the regulations and supplementary regulations published by the 360 Motor Racing Club. The acceptance is also subject to the maximum number of entries allowed for the relevant race.

2. Should an entry be withdrawn, after payment for any reason, the payment is forfeit and not returnable. However, the benefit of the payment may be transferred to another potential entry with the agreement of 360 Motor Racing Club providing that the subsequent entry is eligible according to the terms and conditions and the regulations and supplementary regulations published by the 360 Motor Racing Club and that no such entry has already been received by the 360 Motor Racing Club. In the event of a withdrawal whereby the entered party withdrawing, wishes to transfer the benefit of entry, they should notify the 360 Motor Racing Club as soon as reasonably possible by e mail to info@360mrc.com The 360 Motor Racing Club does not and will not accept any responsibility or liability for failure of any kind including but not limited to system failure of any ISP or subsequent host to notify the 360 Motor Racing Club of the intention to transfer benefit of entry.

3. Should the event be cancelled either by 360 Motor Racing Club or by circumstances outside of The 360 Motor Racing Club’s direct control, then all entrance fees will be returned. This return will be subject to any relevant third party vendor charges including but not limited to bank charges etc. Should the event be postponed by the circuit and another date offered to 360 Motor Racing Club, the new fixture date will be communicated to the registered parties and those registered parties will be automatically registered in the new event. If this is not suitable for any of the registered parties, the new date will be declined and registration and entrance fees will be returnable subject to any third party vendor charges including but not limited to bank charges.

4. In the event of over-subscription drivers may be offered, subject to availability, the opportunity to attend the event as a practicing reserve. Should over subscription happen, when entering, if a practicing reserve place is available, the practicing reserve form entry interface will be used, as such, the entry fee will still be required. An entry must be correctly completed and received at The 360 Motor Racing Club for a car and drivers to be considered as a practicing reserve. Should the entering party accept a practicing reserve place, their entry fee will also be payable on demand as per normal entry as detailed in the terms and conditions within and linked to this agreement and the regulations and supplementary regulations of the 360 Motor Racing Club. Their attendance at the meeting will be accepted together with their attendance of the practice/qualifying period. Should an entrance become available for the race, practicing reserves will be allocated on an “FCFS” (First Come First Served) basis whereby the timestamp of the original entry will be referenced and applied. Should an entry place not be available at the end of the qualifying/practice period, then the practicing reserve entry will receive back 60 (Sixty) percent of the total entrance fee subject to any third party vendor charges including but not limited to bank charges.

INDEMNITY

You will indemnify and hold us, that is, 360 Motor Racing Club and 360 Motor Racing Club Limited  (and our officers, directors, agents, subsidiaries, joint ventures, and employees) harmless from any claim or demand, including reasonable attorneys’ fees, made by you and /or any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party. The committee of The 360 Motor Racing Club reserve the right to refuse any entry to The 360 Motor Racing Club and any event that the 360 Motor Racing Club may organise.
